- Florida--Abbott v. Mylan Orange Book Case
On June 22, 2009, the Court of Appeals of Florida issued a ruling that has significant implications for all states in which generic substitution laws defer to the FDA’s Orange Book as the standard for therapeutic equivalence evaluations. In Abbott Laboratories v. Mylan Pharmaceuticals, the court reversed the earlier ruling of an Administrative Law Judge.
